These Terms and Conditions ("Terms") govern your use of the Bicara Wira website and your participation in any Bicara Wira programme. By enquiring about, enrolling in, or attending a Bicara Wira programme, you agree to be bound by these Terms. If you do not agree, please do not enrol or attend.
Bicara Wira is operated from 65 Jalan Sultan Ahmad Shah, 10050 George Town, Penang, Malaysia. References to "we," "us," and "our" are references to Bicara Wira. References to "you" and "participant" are references to the individual enquiring or enrolled.
1. Definitions
- "Programme" means any of the structured financial education offerings provided by Bicara Wira, including Charting the Present, Considered Investing Foundations, and the Pre-Retirement Pathway Programme.
- "Participant" means any individual who has enrolled in and paid for a Programme.
- "Content" means all materials, session summaries, worksheets, and written documents produced and provided by Bicara Wira within or as part of a Programme.
- "Agreement" means these Terms together with any enrolment confirmation issued by Bicara Wira.
- "Website" means the Bicara Wira website accessible at the domain associated with these Terms.
2. Acceptance of Terms
By submitting an enquiry form on the Website, completing an enrolment, or attending a Programme session, you confirm that you have read, understood, and agree to these Terms. You confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
3. Programme Description and Availability
Bicara Wira offers in-person financial education programmes in George Town, Penang. All Programmes are conducted at 65 Jalan Sultan Ahmad Shah or at an alternative location communicated to enrolled participants in advance. Programmes are available to individuals residing in or able to travel to Penang.
Programme availability is subject to minimum cohort numbers and maximum enrolment caps. Bicara Wira reserves the right to cancel or reschedule a Programme intake with reasonable notice where minimum numbers are not reached or where circumstances beyond our control prevent delivery.
4. Enrolment and Payment
4.1 Enrolment Process
Enrolment in a Programme is confirmed upon receipt of the full programme fee and issuance of a written enrolment confirmation by Bicara Wira. Submission of an enquiry does not constitute enrolment.
4.2 Programme Fees
Current programme fees are as published on the Bicara Wira website. All fees are stated in Malaysian Ringgit (RM) and are inclusive of all Programme sessions, materials, and written session summaries. Fees do not include transportation, accommodation, or any ancillary costs incurred by the participant.
4.3 Refund Policy
Cancellations made more than 14 calendar days before the first session of an enrolled Programme are entitled to a full refund of the programme fee. Cancellations made within 14 days of the first session are not eligible for a refund, but the enrolment may be transferred to a future intake of the same Programme at Bicara Wira's discretion. Bicara Wira does not provide partial refunds for missed individual sessions within a Programme.
If Bicara Wira cancels a Programme intake, enrolled participants will receive a full refund or, at their election, transfer to a future intake.
4.4 Payment Methods
Payment details will be provided upon confirmation of enrolment. Bicara Wira accepts bank transfer and such other methods as may be communicated at the time of enrolment.
5. Participant Responsibilities
As a participant, you agree to:
- Attend sessions punctually and engage with the Programme content in good faith
- Treat other participants, facilitators, and Bicara Wira staff with respect
- Not record, reproduce, or distribute Programme sessions, materials, or Content without written permission from Bicara Wira
- Not share another participant's personal or financial information disclosed during group sessions with any third party
- Provide accurate information when enrolling and during Programme exercises
6. Intellectual Property
All Content produced and provided by Bicara Wira, including session materials, worksheets, written summaries, and Programme methodology, is the intellectual property of Bicara Wira. Participants are granted a personal, non-transferable licence to use Content for their own private financial education purposes. No Content may be reproduced, distributed, sold, or used for commercial purposes without prior written consent from Bicara Wira.
7. Nature of Programme Content — Not Financial Advice
Bicara Wira Programmes provide financial education for informational purposes only. Nothing in any Programme session, material, or communication from Bicara Wira constitutes personalised financial, investment, tax, or legal advice. Participants should consult appropriately qualified and licensed professionals before making any financial decisions.
Bicara Wira does not recommend, endorse, or receive any remuneration in connection with any specific financial product, investment, insurer, or financial service provider. Any references to specific instruments or products in Programme content are made for illustrative and educational purposes only.
8. Confidentiality
Personal or financial information shared by participants in private mentor sessions is treated in strict confidence by Bicara Wira. Information shared in group sessions is shared with other cohort members who are bound by the same confidentiality obligation set out in Section 5. Bicara Wira does not share individual participant financial information with any third party except where required by law.
9. Disclaimers and Limitation of Liability
Bicara Wira Programmes are provided in good faith and with reasonable care. However, we make no warranty that Programme Content will produce any specific financial outcome for any participant. Financial knowledge does not guarantee financial results, and individual circumstances vary significantly.
To the maximum extent permitted by law, Bicara Wira's liability to any participant in connection with a Programme is limited to the programme fee paid by that participant. Bicara Wira is not liable for indirect, consequential, or incidental losses arising from participation in or reliance upon Programme Content.
Nothing in these Terms excludes liability for fraud, personal injury caused by negligence, or any other liability that cannot lawfully be excluded under Malaysian law.
10. Programme Cancellation by Bicara Wira
Bicara Wira reserves the right to cancel or postpone a Programme intake due to circumstances beyond its reasonable control, including but not limited to public health emergencies, natural disasters, or insufficient enrolment. In such cases, affected participants will be offered a full refund or transfer to a future intake.
11. Termination of Participation
Bicara Wira reserves the right to remove a participant from a Programme without refund in cases of serious misconduct, including but not limited to harassment of other participants or facilitators, unauthorised recording of sessions, or wilful breach of confidentiality obligations.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these Terms or a Programme will first be referred to good-faith negotiation between the parties. If a dispute is not resolved within 30 days, either party may refer it to the courts of Malaysia, which will have exclusive jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on our website. Material changes affecting enrolled participants will be communicated by email. Continued participation in a Programme following an update constitutes acceptance of the updated Terms.
